Chapter 7 Bankruptcy

Winter Park Bankruptcy Liquidation Lawyer

When people seek out debt relief through bankruptcy, they may be unsure of what their rights and obligations are. Hiring a skilled bankruptcy attorney can prevent additional problems and ensure your bankruptcy is handled properly.

I am attorney Paul V. Moyer, and I represent people throughout Central Florida with consumer bankruptcy. As an Orlando, Florida Chapter 7 bankruptcy lawyer, I can help you obtain the financial relief you need from credit card debt, unpaid loans and other unsecured debts.

What Is Chapter 7 Bankruptcy?

Chapter 7 bankruptcy, often called bankruptcy liquidation, discharges the unsecured debts of those who qualify for it. As your bankruptcy attorney, I will help you determine your eligibility by walking you through the "means test," which is based on your income, expenses and other factors. Should you qualify, I will help you through the entire procedure.

What Can I Expect to Keep?

One of the many fears people have about bankruptcy is the fear of losing all of their property. In a Chapter 7, many times you can keep certain assets, such as your home, car and other personal possessions, up to a certain dollar amount. I work with you to determine what assets could be considered exempt to maximize what you can keep.

If your house is in foreclosure, a Chapter 7 bankruptcy will slow down the proceedings so you can consider your options, such as seeking a mortgage modification if you qualify for one. Florida Chapter 7 bankruptcy laws provide a "homestead exemption" that allows you to keep your house if you can come current on your mortgage and continue making payments towards it.

You could also consider filing for Chapter 13 bankruptcy in order to stop foreclosure altogether if you can repay the arrears along with the regular payments during the Chapter 13. In some cases, a second mortgage can sometimes be removed in Chapter 13 to make keeping your home a more realistic and achievable goal.
